Terms and Services
1. The Agreement and the Parties
These Terms and Services constitute a legal agreement between the participant (referred to as "the Rider") and Mátyás Demeter Szaszkó, operating as Way & Witness (referred to as "the Operator"). By booking a tour, you acknowledge that you have read, understood, and agreed to these terms in their entirety.
2. Vehicle Requirements and Roadworthiness
Participants are responsible for providing their own motorcycle for the duration of the tour. Every motorcycle must be fully road-legal, registered, and possess all valid documentation and inspections required to be roadworthy within the European Union. The Operator emphasizes that a well-maintained machine is a safety requirement; should a vehicle appear dangerous to the Rider or others, or be in a state likely to cause a mechanical breakdown that disrupts the group, the Operator reserves the right to refuse participation without a refund. While all legal motorcycles are permitted, machines with a capacity below 250cc are not recommended for the pace of these tours.
3. Licensing, Insurance, and Conduct
The Rider must hold a valid driver's license (Class A or A2, as appropriate for the motorcycle) that is legally recognized in the Benelux region. It is the Rider's sole responsibility to maintain legally mandated third-party liability insurance for their vehicle for the duration of the trip. Furthermore, the Operator maintains a strict policy regarding sobriety: neither the Rider nor any passenger may be under the influence of any substances that would violate the laws of the countries through which the tour travels. Any violation of this policy will result in immediate removal from the tour.
4. Cancellation and Refund Policy
Planning a historical expedition involves significant logistical preparation. If a participant cancels 14 days or more before the trip, a full refund will be issued, minus any payment processing fees. For cancellations made between 14 days and 7 days before the start date, a 50% refund is provided, minus processing fees. Cancellations made less than 7 days before departure are not eligible for a refund. These conditions apply strictly, even in the event of force majeure (unforeseeable circumstances). If the Operator cancels the tour for any reason, the customer will receive a 100% refund, including all processing fees.
5. Liability and Assumption of Risk
Motorcycling involves inherent risks. By participating, the Rider and any passengers accept full and entire responsibility for any damages incurred during the trip, whether to themselves, their property, or caused by them to third parties. Mátyás Demeter Szaszkó (Way & Witness) shall not be held liable for any accidents, injuries, or property damage occurring during the tour.
6. Itinerary Flexibility and Safety
History is often subject to the present; therefore, the Operator reserves the right to modify the itinerary if planned attractions are closed or inaccessible. Additionally, the Operator reserves the right to cancel or abort a trip at any time to ensure the safety of the participants. In such safety-related cases, the Operator's decision is final.
